HRCR Category 3 Best Non-Escort Award

Update on Technical Issues Arising at the Pirelli Historic Rally
A Stewards' Hearing was held in Newtown before the start of the Mid Wales Stages and here is the Official Statement from the Stewards:
The Dunlop/Gambia MSA British Historic Rally Championship 2008.
The Championship Stewards met at 9-00am on Saturday 28th June 2008 in Newtown to consider the matter of technical issues following post event scrutineering after the Pirelli Rally, the second round of the Championship.
Those present were Dessie Nutt and Geraldine McBride (the competitors concerned), Simon Marks (the championship co-ordinator), Phil Jones, John Arnold and Mike Sones (the championship stewards).
Documentary and photographic evidence was received from the competitors concerned and the championship officials, together with un-disputed copies of reports and e-mail correspondence.
The championship regulations paragraphs 8.7, 8.8, 8.9, and 8.10 describe the control of eligibility of vehicles and their various components, and the procedures to be taken.
The Stewards find that;-
The competitors failed to comply with paragraphs 8.7, 8.8, and 8.9, by NOT supplying sufficient information regarding the exhaust manifold used on the event.
A Non-Compliance Notice referred to in paragraph 8.10 was NOT issued regarding the exhaust manifold used on the event, and hence no requirement for the production of information within 5 days exists.
The Championship Stewards therefore recommend that;-
The results of the Pirelli Rally be used to allocate championship points in accordance with the Championship Regulations.
The Championship Committee take steps to remind competitors, and reinforce the need to fully comply with Championship Regulations 8.7, 8.8, and 8.9.
Notification of irregularities is rigorously carried out in accordance with regulation 8.10.
This decision is set down at 11-20am on Saturday 28th June 2008.
All parties are reminded of their rights.

Update on Technical Issues Arising at the Historic Tour of Flanders Rally
The Championship Stewards met at Spondon, Derbyshire on Saturday 4th October 2008 to discuss matters arising from post-event scrutineering at Round 7 of the 2008 Dunlop/Gambia – MSA British Historic Rally Championship, the Historic Tour of Flanders. There, a dog change gearbox was discovered in the MG Midget of James Stait / Gill Cotton (Competition Number 270). The rear suspension arms on all the Category C4 Porsche 911s were questioned, the cars of Steven Smith / John Nichols (206) and Dessie Nutt / Geraldine McBride (229) – the only such cars to finish the event - having been issued with Non-Compliance Forms.
An opportunity to provide proof of period use in accordance with Championship Regulation 8.10 was afforded to those involved and after reviewing further written and spoken submissions, the Stewards considered the matter and have instructed the Championship Co-ordinator to remove points from those competitors in accordance with Championship Regulation 8.8.
The competitors were reminded of their rights at the time of announcing the decisions and notice of intention to appeal (to the MSA) was received regarding the Steven Smith / John Nichols Porsche.

The Championship Points Tables that are affected by this Appeal therefore remain Provisional until the Appeal is concluded. As at the start of November, the National Court has received the paperwork concerning the issue but have yet to advise a date for the appeal's being heard.

Decision of the National Court
The MSC National Court sat on Monday 1st December to hear the Appeal by Steven Smith arising from the imposition of penalties arising from Post-Event Scrutineering at the Historic Tour of Flanders. Shortly before this hearing, notice was received that an Enquiry into the BHRC Regulations would be held at the same time.
The findings notice is available to download as a pdf document. The BHRC Regulations have been deemed to have removed statutory judicial levels of MSA Regulations, denying competitors due legal process.
The Court ordered that the BHRC reinstate Steven Smith's, Dessie Nutt's and James Stait's Championship Points for the Flanders Rally 2008.
As a result of the outcome of this hearing, the Championship Rules will, of course, be revisited and revised in preparation for the 2009 Championship. In particular, the five days "window" for the production of evidence will, by necessity, be removed. Therefore, competitors are advised that they must have all supporting evidence in relation to their cars to hand at events. If an item is questioned, and not be able to be substantiated to the Scrutineers, the Non-compliance Notice will be passed immediately to the event Clerk of the Course for action. Any appeals against the CofC's decision will follow the MSA Regulations and the event results will remain provisional until such time that the matter has been addressed.
Revised Points Tables have been posted on the website this morning (Tuesday 9th December) and printed copies will be posted out to all contenders as per Championship Regulations, Article 1.4.
